Safeguarding Adults Service

Best Interest Assessors (BIAs)

Temporary for 18 months. Full time Scale point 32-37 GBP 29,055 - GBP 33,136. Job share considered.

Stockport's safeguarding adult service is creating an interesting opportunity for a motivated and experienced professional. The post holder will need to be qualified to undertake best interest assessments on behalf of the Supervisory Body to support the authorisation of deprivation of liberty safeguards (DOLS).  This statutory duty is required under 2009 addendum to the Mental Capacity Act 2005.  (MCA)

Safeguarding adults at risk is a top priority for Stockport Council. The assessments undertaken by the BIAs provide the main evidence to enable the authorisation of safeguards for people who lack mental capacity to consent to their care and treatment. The principles of the MCA are used by the BIA to benchmark the care arrangements to ensure they are less restrictive and in the person's best interest. The use of conditions recommended by the BIA relating to the deprivation are legally binding and often shine a light on unnecessary restrictions.

Although case law has presented challenges for local authorities regarding DOLS, in Stockport we maintain the view that the authorisation of DOLS provides an opportunity to review care arrangements and ensure restrictive practice is challenged. Senior managers within the council who scrutinise the DOLS assessments are focused on ensuring the human rights of some of the most vulnerable within our communities are respected and upheld. Much has been achieved in this crucial area of work, the outcome of which has resulted in significant positive changes for some individuals.

These newly created posts offer an exciting opportunity for motivated, flexible, talented and experienced professionals who want to be part of a dynamic, developing service that take the Human Rights of vulnerable people seriously.

The successful post holder will be supported to ensure their knowledge is kept up to date via regular supervision, training and workshops. The Mental Capacity (Amendment) Bill 2017-2019 and the move towards Liberty Protection Safeguards will be at the focus of our planned training and supervision.
